The Immigration Act 2049 (consolidated through the 2072 amendment), section 3(1), creates the obligation itself: no foreigner may enter or stay in Nepal without a passport and visa. Section 3(2) delegates visa types, fees and related arrangements to rules, and the Department of Immigration's current visa pages are the operative implementation a traveller is actually governed by; the Rules 2051 (rule 3) confirm the Government's discretion and reciprocity-based exemption power without naming any additional nationality.
Afghanistan is on the Department's list of countries that cannot obtain a Visa on Arrival and must apply in advance; the SAARC note adds that Afghan nationals are eligible on-arrival only with a DoI recommendation, which is not established, so the pre-arrival requirement governs.
