- Entry into Antarctica is conditional on a permit: the traveller must hold the authorisation issued by the Antarctic Treaty Party responsible for the activity (for most travellers, their own State), which each Party grants under the Protocol's prior-assessment and compliance regime (Articles 8 and 13), and the permit sets the duration of stay.

Proposed activities referred to in paragraph 2 below shall be subject to the procedures set out in Annex I for prior assessment of the impacts of those activities on the Antarctic environment or on dependent or associated ecosystems … Each Party shall ensure that the assessment procedures set out in Annex I are applied in the planning processes leading to decisions about any activities undertaken in the Antarctic Treaty area pursuant to scientific research programmes, tourism and all other governmental and non-governmental activities in the Antarctic Treaty area for which advance notice is required under Article VII (5) of the Antarctic Treaty, including associated logistic support activities.

The Protocol on Environmental Protection to the Antarctic Treaty designates Antarctica as a natural reserve (Article 2) and subjects every activity in the Antarctic Treaty area, including tourism, to the Annex I prior-assessment procedures applied by each Party in the planning processes leading to decisions about the activity (Article 8); it creates the obligation that entry requires an advance permit, which each Party then enforces through its own laws under Article 13.
A traveller entering Antarctica is undertaking a tourism activity in the Antarctic Treaty area; Article 8 subjects proposed tourism activities to the Annex I procedures for prior assessment and requires each Party to apply those procedures in the planning processes leading to decisions about the activity, so entry cannot proceed without the Party’s prior assessment and authorisation — the permit — arranged in advance.
