- The issuer is not listed among the concessional entry arrangement countries in the Schedule to Legal Notice 128 of 2025 and is not an exempt person under section 11 of the Act, so the general visa requirement in section 10 applies to it.
- A holder of a British Overseas Territories Citizen passport issued by Anguilla, the British Virgin Islands, the Cayman Islands, Montserrat or the Pitcairn Islands is a national of a concessional entry arrangement country and is granted a visitor visa on arrival; the traveller can tell from their own passport whether their issuing territory is listed.

A non-citizen who is not an exempt person must not:
(a) enter Solomon Islands; or
(b) having entered, stay in Solomon Islands;
unless the non-citizen holds a visa that is in force.

Section 10 of the Immigration Act 2012 creates the obligation: a non-citizen who is not an exempt person must not enter or stay in Solomon Islands unless holding a visa in force. The concessional entry notice (LN 128/2025) and the Immigration Regulations 2013 only implement exemptions and terms under that Act, so the Act is the instrument that creates the requirement this regime answers.
Section 10 of the Immigration Act 2012 is the general class rule that creates the visa obligation: it requires 'a non-citizen who is not an exempt person' to hold a visa. It names no issuer because the class is defined by the exemptions; these issuers are the residue of the concessional entry list and are not otherwise exempt, so the requirement applies to them.

No. 37) on Tuesday 24 June 2025; it repeals Legal Notices No. 10 of 2017, No. 110 of 2024 and No. 113 of 2025. The Immigration Act 2012 reprint is 'As in force at: 5 February 2024'.
