RA 38/2021 creates the obligations that govern this regime: art. 7 (visa and prior entry authorisation), art. 8 (entry-and-stay authorisation at the border posts, i.e. visa on arrival), art. 9 (exemption from visa and prior entry authorisation) and art. 10 (maximum stay periods). The CPSP page describes that regime and publishes the current list; Despacho 165/2010 adds the six-country prior-visa requirement under arts. 8(3) and 9(1)(4).
Article 8 of RA 38/2021 allows the border police to grant an entry-and-stay authorisation at the migration posts to any non-resident arriving without a prior visa or authorisation, for up to 30 days; nationals not on the exemption list — and not excluded by the Chief Executive's despacho (the six countries in Despacho 165/2010) — use this visa-on-arrival route.
