The Immigration Act 2049 (consolidated through the 2072 amendment), section 3(1), creates the obligation itself: no foreigner may enter or stay in Nepal without a passport and visa. Section 3(2) delegates visa types, fees and related arrangements to rules, and the Department of Immigration's current visa pages are the operative implementation a traveller is actually governed by; the Rules 2051 (rule 3) confirm the Government's discretion and reciprocity-based exemption power without naming any additional nationality.
The Department of Immigration names these countries as unable to obtain a Visa on Arrival and requires them to apply in advance through a Nepalese Embassy or the online mission portal, so advance authorisation is required.
