مادة (3)يشترط لدخول الأجنبي لدولة الكويت أن تكون لديه سمة دخول صادرة من الإدارة العامة لشئون الإقامة، أو من أي منفذ من منافذ الكويت أو من إحدى السلطات الكويتية المختصة بذلك في الخارج، أو أن تكون لديه إقامة عادية سارية المفعول.ويعفى من الحصول على سمة الدخول رعايا الدول التي يصدر بها مرسوم بناء على عرض وزير الداخلية وبشرط المعاملة بالمثل.

Amiri Decree-Law 114/2024 on the Foreigners' Residence Law is the statute that creates the entry regime: its first chapter requires foreigners to hold a valid passport or travel document to enter and leave Kuwait (GCC citizens excepted), its second chapter empowers the Minister of Interior to set entry-visa types and procedures, and it makes an entry visa the default for foreign nationals unless exempted by decree; the executive regulation and ministerial decisions implement these delegations.
Article 3 of the executive regulation (Ministerial Decision 2249/2025) requires every foreigner entering Kuwait to hold an entry visa issued by the Residency Affairs department, a Kuwaiti port, or a competent Kuwaiti authority abroad, unless exempted by decree; none of these issuers appears on the visa-on-arrival list or in the GCC exemption, so the general entry-visa requirement applies and must be arranged before travel.
