- Be in possession of a valid unexpired ICAO compliant, machine readable passport issued by a country that meets the eligibility requirements of paragraph (q)(2) of this section
- Be in possession of a round trip ticket that is nonrefundable and nontransferable and bears a confirmed departure date not exceeding forty-five days from the date of admission to Guam or the CNMI
- (A) Hong Kong Special Administrative Region (Hong Kong). To be eligible to participate in the program as a result of a connection to Hong Kong, the following documentation is required: A Hong Kong Special Administrative Region (SAR) passport with a Hong Kong identification card; or a British National (Overseas) (BN(O)) passport with a Hong Kong identification card.

8 CFR 212.1 is the regulation that imposes the visa and documentary requirement on arriving nonimmigrant aliens (chapeau) and that creates and specifies the Visa Waiver Program exemption (i), the Guam-CNMI Visa Waiver Program (paragraph (q)) and the CNMI EVS-TAP (paragraph (r)); it implements INA 212 and Pub. L. 110-229 and is the operative instrument for who may enter Guam and the CNMI without a visa.
The regulation makes Hong Kong SAR and BN(O) passport holders eligible for the Guam-CNMI Visa Waiver Program when they hold a Hong Kong identification card, with the same 45-day stay and electronic travel authorization requirement as the other program countries.
