第 1 條 本辦法依香港澳門關係條例（以下簡稱本條例）第十一條第二項及第十二條第一項規定定之。 … 香港或澳門居民在當地出生、曾進入臺灣地區或持有第一項入出境證件，申請臨時入境停留三十日內離境者，得持有效期間三個月以上之香港護照、英國國民（海外）護照或澳門護照及訂妥機（船）位之回程或離境機（船）票，於入境時向移民署申請發給臨時入境停留許可，持憑入出境；其持有之第一項入出境證件，不予註銷。

Aevamo’s reading

Article 6 of the Foreign Passport Visa Act is the instrument that CREATES the obligation: "持外國護照者，應持憑有效之簽證來我國" — foreign-passport holders must enter with a valid visa — and it delegates to MOFA the power to carve out visa-exempt and visa-on-arrival treatment. The BOCA lists exercise that delegation and therefore describe an obligation the Act creates.

Art. 10(5) grants eligible HK/Macau residents a temporary entry-stay permit applied for at entry, staying within 30 days, so no advance authorisation is needed for those who qualify.
