This arrêté, made under the CESEDA (articles L. 211-1 and R. 211-1) and published in the Journal officiel, is the instrument that imposes the visa requirement for entry into the collectivity of Saint-Barthélemy: Article 1(b) requires a valid visa where Annexe II makes it necessary and Article 3 grants the dispense only to persons listed in Annexe II. It is the obligation-creating instrument, not a summary.
The annex heading fixes the exemption for stays 'dont la durée n'excède pas 90 jours sur toute période de 180 jours', and each listed country appears in Annexe II §1 with a 'tout type de passeport' dispense, so holders of the ordinary passport enter visa-free for up to 90 days in any 180-day period.
