Regulation 2 of the Immigrants and Emigrants Regulations 1956, made under section 48 of the Immigrants and Emigrants Act No. 20 of 1948, requires every person to whom section 10 of the Act applies to hold a visa to enter Sri Lanka; that is the instrument that creates the visa obligation which the Department's ETA system and the 2026 fee-waiver scheme implement and apply.

The notice names these 40 countries and grants them a free 30-day tourist visa (ETA); because the ETA system's own FAQ states that the ETA is not a precondition to board and its fees page lists 'On arrival' as a method of obtaining the tourist visa, these nationals can enter without arranging anything in advance, obtaining the 30-day visa on arrival.
