5. Save where expressly indicated throughout these Rules, these Rules do not apply to an Irish citizen who as a result of section 3ZA of the Immigration Act 1971 does not require leave to enter or remain, but an Irish citizen who does require leave to enter or remain is covered by these Rules.

The Jersey Immigration Rules are laid down by the Minister for Home Affairs under the Immigration Acts as extended to Jersey by the Immigration (Jersey) Order 1993; they create the obligation to obtain entry clearance (a visa) before arrival for visa nationals and an ETA for ETA nationals. The UK appendices are incorporated by reference and supply the nationality lists; they describe who the Jersey rule reaches, they do not create the Jersey obligation.

Paragraph 5 places Irish citizens who do not require leave (under s3ZA of the Immigration Act 1971, the Common Travel Area provision) outside these Rules altogether, so they enter Jersey free of immigration control with no stay cap.
