For the purposes of this Act, every Kiribati citizen has, by virtue of his or her citizenship, the right to enter and be in Kiribati at any time.

The Kiribati Immigration Act 2019 creates the obligation: section 8 provides that persons other than Kiribati citizens must hold a visa to travel to and be in Kiribati, and section 28/62 create the waiver power. The Entry and Visa Exemption Order 2023 is the waiver instrument made under s.62(1),(2) of this Act, so the Act is the source of both the default requirement and the exemption power. The -ilo id is the same Act as a text-extractable copy hosted by ILO NATLEX.
Section 7(1) of the Immigration Act 2019 gives every Kiribati citizen an unconditional right to enter and be in Kiribati at any time, so holders of the Kiribati passport are not subject to the visa regime at all.
