Section 4(1) of the Immigration Act 1982 creates the obligation: no person other than a citizen of Swaziland shall enter Swaziland unless in possession of a valid entry permit or pass. The Act is the instrument that imposes the requirement; the ministry's visa list and the regulations' Sixth Schedule describe who is exempt from the visa prerequisite, not the requirement itself.

The Ministry of Home Affairs' list marks each of these five countries with 'N' under 'Visa required (Y=yes N=no)', meaning their nationals are not required to hold a visa.
