A valid unexpired visa that meets the requirements of part 215, subpart B, of this chapter, if applicable, and an unexpired passport, shall be presented by each arriving nonimmigrant alien except that the passport validity period for an applicant for admission who is a member of a class described in section 102 of the Act is not required to extend beyond the date of his application for admission if so admitted, and except as otherwise provided in the Act, this chapter, and for the following classes: … A visa is not required of any alien who is eligible to apply for admission to the United States as a Visa Waiver Program applicant pursuant to the provisions of section 217 of the Act and part 217 of this chapter if such alien is a national of a country designated under the Visa Waiver Program, who seeks admission to the United States for a period of 90 days or less as a visitor for business or pleasure.

Section 212.1 is the DHS regulation that imposes the visa-and-passport requirement on each arriving nonimmigrant alien and then enumerates the classes that do not have to present a visa. The VWP list and the 212(f) proclamations operate as exceptions or overlays on that command; they do not replace it.

The opening command is the default; the VWP paragraph and the other lettered exceptions are the only off-ramps this instrument writes, so an issuer found on none of those off-ramps remains under the visa command.
