‘Member State’ shall mean any Member State of the Union, with the exception of the United Kingdom and Ireland; … Citizens of the Union holding a valid ordinary, diplomatic, service, official or special passport issued by a Member State may enter and stay without a visa in the territory of Tonga for the period of stay as defined in Article 4(1). … Citizens of the Union may stay in the territory of Tonga for a maximum period of 90 days in any 180-day period.

The Immigration Act (Cap. 62), s.6 creates the obligation: no person other than a citizen of the Kingdom shall enter Tonga unless holding a valid permit or exempted under s.7. s.10 limits a visitor's permit to 6 months and s.38 empowers Cabinet to exempt classes of persons. The revenue/embassy lists describe how that permit requirement is administered, but the Act is the instrument that creates it.

Article 2(a) defines 'Member State' as any EU member except the UK and Ireland; Article 3(1) makes citizens of those states enter and stay without a visa in Tonga; Article 4(1) fixes the stay at a maximum of 90 days in any 180-day period.
