- The exemption turns on the issuer being a national of a member country of a community space of which Burkina Faso is a party. The AES was created by the treaty signed at Niamey on 6 July 2024 by Burkina Faso, Mali and Niger, whose Article 5 commits the confederated states to promote the integration of peoples by facilitating the free movement of persons, goods and services and the right of residence and establishment in the confederal space.
- The control consists of verifying possession of a valid national, consular or community identity document, so the holder must carry one of those documents and it must be valid.

Loi n°001-2024/ALT of 22 February 2024 fixes the conditions of entry and stay of foreigners and repeals the 1984 ordinance; it is the instrument that creates the visa obligation for foreigners entering Burkina Faso, subject to community rules, international conventions and reciprocity. The e-visa portal describes how that obligation is operated.
Article 65 of Décret n°2025-0288 provides that for nationals of member countries of a community space of which Burkina Faso is a party, border control consists only of verifying possession of a valid national, consular or community identity document — not a visa. That is the general visa requirement of Article 4 not biting for this class. Burkina Faso is a founding party to the AES confederation, whose treaty establishes a confederal space and whose free movement is underwritten by the AES declaration of 14 December 2024 declaring the AES 'un espace sans visa'; Mali and Niger are the other two confederated states. The row carries no day count because the decree states none for this class: it replaces the visa check with an identity-document check, which is why limitKind is NO_LIMIT rather than a number read off the visa categories in Article 16.
