Article 15.2 of the Migration Code creates the obligation — a foreigner entering Azerbaijan must obtain a visa — and 15.3 creates the only exemptions; the MFA's lists and the e-visa portal implement that delegation rather than create it.

Article 15.2 imposes the general rule that a foreigner must obtain a visa to enter Azerbaijan, and 15.3 creates the only exceptions (an international agreement or a decision of the executive authority); issuers on no exemption list therefore fall under the visa requirement.
