Act 2026-11 s.45(2) imposes the visa requirement on nationals who need a short stay visa under Union law, and s.45(3) exempts those who do not; s.41(2) grants citizens of the Union visa-free entry for 90/180 days. It is the instrument that CREATES the obligation for Gibraltar, applying the EU lists by reference; Reg (EU) 2018/1806 supplies the lists themselves.
Article 4(1) exempts Annex II nationals only for stays of no more than 90 days, but the footnote (7)/(11) conditions the exemption on an EU visa waiver agreement entering into force; the register shows that condition is not met for Micronesia and Nauru, so under s.45(2) of the Treaty Act they require a visa for Gibraltar.
