- A permit from the U.S. Fish and Wildlife Service is required before entering the national wildlife refuges that form the US Minor Outlying Islands; whether a traveller holds that permit is particular to them.
- Wake Island is not a national wildlife refuge: its civil administration is vested in the Secretary of the Air Force (32 CFR 935.10(a)), and entry to the Wake Island defensive area is controlled — persons, ships and aircraft are excluded unless and until they qualify for admission.

§ 26.22 General exception for entry.
(a) Any person entering or using any national wildlife refuge will comply with the regulations in this subchapter C, the provisions of any special regulations and any other official notification as is appropriate under § 25.31.
(b) A permit shall be required for any person entering a national wildlife refuge, unless otherwise provided under the provisions of subchapter C. The permittee will abide by all the terms and conditions set forth in the permit.

50 CFR §26.22(b) is the operative regulation that creates the obligation: 'A permit shall be required for any person entering a national wildlife refuge, unless otherwise provided under the provisions of subchapter C.' It is the rule itself (the current eCFR text of the codified U.S. Fish and Wildlife Service regulation), not a description of a rule created elsewhere; the official CFR edition (cfr-part26) prints the identical text.
Section 26.22(b) makes a permit a condition of entering any national wildlife refuge; the national wildlife refuges of the US Minor Outlying Islands (Baker, Howland, Jarvis, Johnston Atoll, Kingman Reef, Midway Atoll, Palmyra Atoll, Navassa Island) are national wildlife refuges, so every traveller to them must hold a permit in advance — the permit requirement applies to any person and draws no nationality distinction.
