  • For nationals of member countries of a community space of which Burkina Faso is a party, border control consists of verifying possession of a valid national, consular or community identity document, so the holder must carry one and it must be valid.
  • The AES declaration grants the right to enter, circulate, reside, establish and leave subject to Burkina Faso's own laws in force, and reserves the right to refuse entry to any ECOWAS national falling within the category of inadmissible immigrants under national law. The general visa rule of Article 4 applies subject to exemption accords, so this row and the general rule operate alongside each other.

Les ressortissants de la CEDEAO ont le droit d’entrer, de circuler, de résider, de s’établir et de sortir sur le territoire des Etats membres de la Confédération des Etats du Sahel dans le respect des textes nationaux en vigueur.

Loi n°001-2024/ALT of 22 February 2024 fixes the conditions of entry and stay of foreigners and repeals the 1984 ordinance; it is the instrument that creates the visa obligation for foreigners entering Burkina Faso, subject to community rules, international conventions and reciprocity. The e-visa portal describes how that obligation is operated.

This is the AES Heads of State declaration of 14 December 2024, published by Burkina Faso's own Ministry of Foreign Affairs. It declares the Sahel confederation a visa-free space for every national of an ECOWAS Member State and states the right in operative terms: the Confederation 'est un espace sans visa pour tout ressortissant des Etats membres de la CEDEAO', and ECOWAS nationals 'ont le droit d'entrer'. Burkina Faso is a member of the AES and is the destination, so this is the instrument that grants the exemption on Burkina's side. It is preferred to the 1979 ECOWAS Protocol because Burkina Faso has left ECOWAS and the protocol is a doubtful addressee of a community rule; the declaration covers the same population by naming ECOWAS Member State nationality directly. The declaration states no duration, so the 90 days is taken from the Ministry of Security's own stay rule under fieldSources — Burkina's current threshold, which expressly reaches 'any foreigner'.
