Regulation (EU) 2018/1806 is the instrument that creates the obligation: Article 3(1) requires nationals of Annex I third countries to be in possession of a visa when crossing the external borders, and Article 4(1) grants the Annex II exemption. The Schengen Borders Code supplies the 90-in-180 duration but does not itself impose or waive the visa requirement.

The Schengen Borders Code applies its entry conditions — including the visa requirement in Article 6(1)(b) — only to ‘third-country nationals’, and Article 2 point 6 defines that term to exclude Union citizens and persons enjoying the right of free movement under Union law (point 5(a) and (b)). The nationals of these EU/EEA/CH states are Union citizens or persons with equivalent free-movement rights, so they fall outside the visa regime and its 90/180-day cap.
