Article 6 of the Foreign Passport Visa Act is the instrument that CREATES the obligation: "持外國護照者,應持憑有效之簽證來我國" — foreign-passport holders must enter with a valid visa — and it delegates to MOFA the power to carve out visa-exempt and visa-on-arrival treatment. The BOCA lists exercise that delegation and therefore describe an obligation the Act creates.

Act Art. 6 states the default: foreign-passport holders must enter with a valid visa, and the visa-exempt/visa-on-arrival treatment is an exception granted to named nationalities. None of these issuers is named in any exception list I hold, so the default applies to them.
