Regulation (EU) 2018/1806 is the instrument that creates the obligation: Article 3(1) requires nationals of Annex I third countries to be in possession of a visa when crossing the external borders, and Article 4(1) grants the Annex II exemption. The Schengen Borders Code supplies the 90-in-180 duration but does not itself impose or waive the visa requirement.

Article 4(1) exempts nationals of Annex II countries for 90 days in any 180-day period, and Annex II lists each of these issuers with note 7 or 11, which makes the exemption conditional on the entry into force of a visa-waiver agreement with the EU.
