Article 15 of the Exit and Entry Administration Law creates the obligation: foreigners entering China shall apply in advance to the visa authorities abroad for a visa unless exempt. Article 22 enumerates the four exemption grounds, under which the unilateral visa-free list and the mutual visa-exemption agreements are issued. The Law is therefore the instrument that imposes the requirement, while the lists implement its exemptions.
The NIA service guide states Taiwan residents arriving at an entry port without a valid travel document may obtain a one-time Mainland Travel Permit on arrival, issued valid for three months for a single entry, so a Taiwan resident can enter without advance authorisation when arriving at a designated port.
