The visa-free travel and short stay visa provisions of the Treaty on Gibraltar and the European Union Act 2026 entered into force on 15 July 2026.
The Annex II footnotes that make an exemption begin at an event are resolved: the visa waiver agreement footnotes (7) and (11) are operative as recorded in the EUR-Lex register, and the ETIAS/1 January 2024 footnote (20) trigger has passed. The entries carrying those footnotes are answered in their own rows.
The exemption from the visa requirement shall only apply to holders of biometric passports.
The exemption from the visa requirement shall apply from the date of entry into force of an agreement on visa exemption to be concluded with the European Union; the EUR-Lex register of visa waiver agreements records the operative dates of those agreements, and the entries carrying footnotes (7) and (11) are answered in their own rows.

Act 2026-11 s.45(2) imposes the visa requirement on nationals who need a short stay visa under Union law, and s.45(3) exempts those who do not; s.41(2) grants citizens of the Union visa-free entry for 90/180 days. It is the instrument that CREATES the obligation for Gibraltar, applying the EU lists by reference; Reg (EU) 2018/1806 supplies the lists themselves.

The Annex II list exempts these nationals from the visa requirement for stays of no more than 90 days in any 180-day period, and s.45(3) of the Treaty Act applies that exemption to entry into Gibraltar.
