4. Exemption from visa requirement … Subject to subsection (3), a person who is a subject or a citizen of a country referred to in Schedule 4 shall not require a visa to be allowed entry into Saint Lucia.

Aevamo’s reading

The Immigration (Visa) Order, made under s.7(3) of the Immigration Act, imposes the visa requirement: s.3(1) makes the passport of a subject or citizen of a country listed in Schedule 1 unacceptable for entry unless it bears a valid visa, and s.3(2)-(3) distinguish visa on arrival from visa prior to arrival. It creates the obligation rather than reporting it; the External Affairs lists and bilateral agreements describe or modify it.

The exemption from the visa requirement is confined to subjects or citizens of countries referred to in Schedule 4; these issuers (British protected person, British subject, British overseas citizen, South Sudan, Holy See, stateless and refugee classes) are not named in Schedule 4 or any other exemption list held, so the ordinary requirement that a visa be obtained before travel applies to them.
