Décret n° 87-076, reproduced in the Ministry of Justice's official compilation, is the implementing regulation that CREATES the visa obligation: Art. 2 requires every foreigner entering Niger to hold a passport bearing a Nigerien visa, and Arts. 3-5 define the exemptions (reciprocal visa-abolition agreements, air transit, border-zone nationals). It does not merely describe the position; it imposes the requirement. The AIP GEN-1.3 records the current set of states to which the exemption applies, a later fact the 1987 decree cannot contain.
The AIP — Niger's official published entry requirements valid from 09 JUL 2026 — lists the ordinary-passport visa-free states: item 1 (Mauritania, Morocco, Sweden, Tunisia), item 7 (UEMOA members Benin, Burkina Faso, Côte d'Ivoire, Guinea-Bissau, Mali, Senegal, Togo) and item 18 (ECOWAS members Benin, Cabo Verde, Côte d'Ivoire, Gambia, Ghana, Guinea, Guinea-Bissau, Liberia, Nigeria, Senegal, Sierra Leone, Togo), each for a stay not exceeding 3 months.
