The Vreemdelingenbesluit 1995 (Aliens Decree, S.B. 1995 no. 85), implementing the Vreemdelingenwet 1991, creates the entry obligation: Article 12 requires every alien to hold a passport carrying a visa unless the Minister designates an exemption. The current Entry-Fee regime and the 21-country visa/tourist-card list are later modifications of that obligation made by decree (S.B. 2022 no. 68, S.B. 2023 no. 76, S.B. 2024 no. 13) and ministry measures, so the decree is the instrument that creates the obligation the later instruments modify.
The Staatsblad Beschikking of 9 May 2023 declares the tourist card applicable again to nationals of Cuba, the Dominican Republic, Venezuela and India, so these four issuers must obtain the tourist card in advance rather than entering visa-free.
