Section 29(1) of the Immigration Act Cap 54 creates the obligation: a person to whom it applies shall not enter or remain in Tanzania unless holding a passport with a visa, a residence permit or a pass. The Immigration (Visa) Regulations, including the exemption (Third Schedule) and referral (Fourth Schedule) categories and the ninety-day visa validity, are made under the Act, so the Act is the instrument that creates the entry obligation.
The Immigration Department's current list names the countries whose nationals require a referral visa; the department's Referral Visa Cases page explains that these nationals may not obtain a visa on arrival and must obtain special clearance from the Commissioner General before arriving, so advance authorisation (an online application with approval before travel) is required. The approved visa is the Ordinary visa capped at ninety days (fieldSources).
